The terms that govern orders and use of our website

These Terms of Service (“Terms”) govern your use of the website operated by Antonio's Bakery & Macarons (“Antonio's,” “we,” “us,” or “our”) and any order you place with us, whether online or in store. By placing an order, signing our Order Agreement, or otherwise using our website, you (“Client” or “you”) agree to these Terms in full. If you do not agree, please do not place an order or use the site.
For custom and event orders, you will also be asked to review and electronically sign our Order Agreement at checkout. The Order Agreement controls the specific order it accompanies; these Terms apply generally. Where the two overlap, both are intended to be read together and enforced to the fullest extent permitted by law.
1. Pricing & Quotes Are Final
All prices quoted to you are final and non-negotiable. A quote is a quote: the price we provide for an order is the price, and it will not be reduced by negotiation after the fact. Any estimate provided online, in store, by phone, or by email is preliminary and may be adjusted upward to reflect the actual scope of work — including design complexity, specialty decorations or premium materials, size adjustments, rush scheduling, or any other factor affecting the order. The final invoiced amount may differ from a prior estimate, and such a difference is not a billing error. You will be notified of any material price adjustment before your order is confirmed and charged.
2. Coupons & Promotional Offers
Coupons, promo codes, discounts, and special offers are only redeemable at the specific point of sale and through the specific channel for which they were issued, and are subject to all terms printed on or accompanying the offer.
- “In Store Only” means in store only. Any coupon, code, or offer designated “In Store Only” (or words of similar effect) is strictly limited to in-person, in-store transactions and may not be applied to online orders under any circumstances — regardless of any instruction, suggestion, or representation by any employee directing you to place your order online.
- Online orders are processed through a separate platform governed by separate pricing terms. We do not offer blanket or automatic discounts on online orders.
- No coupon or promotional offer may be applied retroactively, transferred, combined, or honored on a transaction to which it does not apply by its own printed terms.
- The terms printed on the face of any coupon or offer are the complete and binding terms of that promotion. A quoted or final price will not be reduced after the fact on the basis of a coupon or promotion that does not apply to the transaction.
3. Employee Representations & Authority
Any verbal representation, assurance, promise, instruction, quote, or statement made by any Antonio's employee or representative — whether in store, by phone, by text, by email, or through any other informal channel — does not supersede, modify, waive, or override these Terms, our Order Agreement, the terms printed on any coupon or promotional offer, or our published pricing and promotional policies.
Employees are not authorized to: (a) guarantee the applicability of any discount, coupon, or promotion outside the channel for which it was issued; (b) promise a price that deviates from a finalized quote or final invoice; (c) waive any term of these Terms or our Order Agreement; or (d) bind Antonio's to any term inconsistent with these Terms. Any such representation, if made, is made without authority and is not binding on us. You may not rely on an employee representation that conflicts with these Terms, a coupon's printed terms, or our published policies as the basis for any claim, discount, credit, refund, or price adjustment.
4. Payment & Order Confirmation
Full payment is required before production of any custom order begins; no order is produced until payment is confirmed. By placing an order and providing a payment method, you authorize Antonio's to charge that payment method for the final confirmed amount of your order, which may differ from a preliminary estimate as described in Section 1.
5. Custom Design & Appearance
All custom cakes, cupcakes, macarons, and bakery items are entirely handcrafted and subject to natural variation. Any inspiration photo, reference image, sketch, or description you provide is guidance only — the finished product is our artistic interpretation of your request and will not look exactly like any reference. Variations in color, texture, sizing, design details, and overall appearance are inherent to handcrafted goods and do not constitute a defect or a basis for a refund.
6. Food Allergies & Dietary Disclosure
You are solely responsible for disclosing all known food allergies, dietary restrictions, and health conditions for everyone who will consume the ordered items, at the time of ordering. Our kitchen handles common allergens including wheat/gluten, dairy, eggs, tree nuts, peanuts, soy, and sesame. We are nota certified allergen-free facility and cannot guarantee against cross-contamination. To the fullest extent permitted by law, Antonio's is not liable for any allergic reaction or adverse health event arising from consumption of our products, and you assume all risk of consumption.
7. Refunds & Cancellations
All sales are final.There are no refunds once payment is made, except where production of your order has not yet begun, as determined solely by Antonio's. “Production” includes sourcing ingredients, scheduling, design work, baking, assembly, decoration, or staging. Once production has begun in any form, no refund, store credit, or other compensation will be issued. Cancellation and modification requests are honored only before production begins; please see your signed Order Agreement for the full cancellation tiers that apply to your order.
8. Pickup, Delivery & Shipping
For pickup orders, you must collect your order within one (1) hour of the scheduled pickup time. Late pickups may incur a fee of $10.00 per hour (up to $50.00/day), and orders not collected within 24 hours may be treated as abandoned with no refund. For delivery orders where delivery cannot be completed because you are unavailable, you remain responsible for the full order cost plus any applicable re-delivery fee. Shipping timeframes are estimates and are not guaranteed.
9. Gratuity
Our bakers, decorators, and event staff are skilled professionals. Gratuity is appreciated and, for certain orders and events, a service charge may be applied as described in your Order Agreement.
10. Chargebacks & Payment Disputes
By placing an order, you agree not to initiate a chargeback, payment reversal, or dispute for charges that are consistent with these Terms and your Order Agreement. Unauthorized chargebacks constitute a material breach and entitle Antonio's to recover the disputed amount, processor fees, administrative costs, and reasonable attorneys' fees and collection costs.
11. Online Reviews
You retain the full right to post honest, truthful reviews reflecting your genuine experience. However, you agree not to post false, misleading, or defamatory statements about Antonio's. Knowingly false or defamatory public statements may give rise to liquidated damages as set out in your Order Agreement, in addition to any other remedy available at law.
12. Dispute Resolution & Mandatory Mediation
Any dispute arising out of or relating to these Terms, your Order Agreement, or our products or services must first be submitted to mandatory mediation as set out in your Order Agreement, before any other legal proceeding may be brought. You agree to the mediation, cost-allocation, arbitration, jury-trial-waiver, and class-action waiver provisions described in the Order Agreement. Nothing herein limits Antonio's right to pursue collection of unpaid amounts or enforcement of these Terms in any court of competent jurisdiction.
13. Limitation of Liability
To the fullest extent permitted by law, Antonio's total liability for any claim arising out of or related to these Terms or any order shall not exceed the total amount you actually paid for the specific order at issue. In no event shall Antonio's be liable for any consequential, incidental, punitive, indirect, or special damages, including emotional distress, lost profits, or event disruption.
14. Reservation of Rights & Changes
Antonio's reserves all rights not expressly granted, including the right to refuse service to anyone at any time in its sole discretion. We may update these Terms from time to time; the updated version is indicated by the “Last Updated” date above and applies to orders placed after it is posted. Please review these Terms periodically.
